Town of Boone Notification of Discharge of Untreated Wastewater

Town of Boone, North Carolina— General Statute 143-215.1C requires that the owner or
operator of any wastewater collection or treatment works to issue a press release when an
untreated wastewater discharge of 1,000 gallons or more reaches surface waters. In accordance
with that regulation, the following news release has been prepared and issued to the media in the
affected county: Watauga County.

The Town of Boone Sanitary Sewer System had a discharge of untreated wastewater on August
9th, 2025 of an estimated 25,000 gallons at 190 Hardin Street, the site of the old Legends
Theatre. The untreated wastewater was discharged into an unnamed tributary of Boone Creek in
the New River River Basin through a stormdrain. Mitigation was put into place by midnight,
August 10th, which will temporarily pump the untreated wastewater around the breach. The
cause of the breach was found to have been due to demolition at the Legends Theatre site. The
sanitary sewer pipe is awaiting repair. The Division of Water Resources was notified of the event
on August 10th, 2025, and is reviewing the matter. For more information, contact Public Utilities
